The victim has filed a defamation suit against a Bangladeshi businessman seeking for two and a half million dollars (Tk 21 crore 52 lakh 50 thousand in Bangladeshi currency) for harassing an expatriate instrumentalist in a fake weapons case in New York.

Victim's lawyer Miali A. Makelele filed the lawsuit against the businessman in the Queens County Criminal Court in New York on Monday ( January 31) for police harassment and fraud by posting a pistol image through Photoshop on the expatriate instrumentalist Facebook photo.

In the case filed Partha Gupta's reputation for a decade and a half as a social and mentally degraded artist has been severely tarnished, citing his former business partner filed a defamation suit in the name of Home Care and Insurance businessman Shahnawaz his company Golden Home Care, NY Auto Insurance, wife Amena Nawaz, associate Mostofa Anik Raj and John & Jane Doe seeking $2.5M million (Tk 21 crore 52 lakh 50 thousand in Bangladeshi currency) compensation.

According to the lawsuit New York expatriate instrumentalist Partha Gupta's former partner home care and insurance businessman Shahnawaz took photos from Partha's Facebook and placed a pistol next to the photo in Photoshop.Shahnawaz used Partha Gupta's credit card to withdraw $5,000 and did not return it.

Last year, when there was a conflict and disagreement between the two on business issues, an arbitration meeting was held in his office. As the matter was not resolved there, Perth got in the car to return home. At that time, Shahnawaz's associate Mostafa Ani Raj came and threatened him and tried to force him to sign the arbitrator's paper. At that time, he openly mentioned Shahnawaz's wife Rano Nawaz as his girlfriend. That's why he tried to force her to sign the paper.

Shahnawaz complained to police that Partha Gupta had sent him text messages threatening to kill him and threatening to shoot him with a pistol after a cultural program. In support of this he showed police a picture of Partha Gupta with a pistol on his bed next to the photo made in Photoshop.

Two months earlier on August 29 last year at a Pathmela (Street fair) organized by Bangladeshis at 76-36 Street in Jackson Heights at around 6:30 pm Ex partner of Golden Age Home Care Shahnawaz was beaten by a group of people including a popular instrumentalist Partha Gupta.

During this time they displayed dangerous devices (pistols, revolvers, rifles, shotguns or machine guns) intended to kill him (Case docket number - 'CR-020560-21QN'). He wants police help to secure his life. He complained to the police about the death threat. Following the allegations Taylor Scala a police officer in the Northern Boulevard-115 area of Jackson Heights, called Partha to the police station on the evening of October 4 last year for questioning.

After receiving a phone call, Partha Gupta voluntarily went to the police station and detained him at the Northern Boulevard-115 police station till night after interrogation.
The next day on October 5, Partha Gupta was sent to the nearest criminal court and the wise judge granted him bail. The court also directed to maintain distance from the plaintiff Shahnawaz.

New York home care and insurance businessman Shahnawaz failed to prove the veracity of the lawsuit filed against him (Case docket number - 'CR-020560-21QN') The court also acquitted businessman and instrumentalist Partha Gupta.

The lawsuit alleges that Shahnawaz a New York home care business fraudster embezzled money from a federal government loan for the "pay protection program" or pay-check protection program (PPP) for home care business employees. The two partners took out a Pay-Check Protection Program (PPP) loan of $ 5,24,729 (Approximately Tk 4,46,1,965 in Bangladeshi currency) from the US Central Government through fraudulently showing 140 employees in two home care businesses. Shared together. They transferred money from the company's bank account to their own bank.

Parth Gupta was a partner in Bengal Home Care Inc. and Golden Age Home Care. In the name of these two organizations, Shahnawaz had a falling out with partner Shahnawaz for seeking an account of the loan provided by the Central Government (Federal) Government for the Pay-Check Protection Program (PPP).

At 1:29 pm on September 10 last year, his business partner, home care and insurance businessman Shahnawaz, filed a death threat with the Jackson Heights Northern Boulevard-115 area police in the New York City Police Department, five months before the harassment.

Shahnawaz had two home care companies (Bengal Home Care Inc. and Golden Age Home Care) after the federal government announced Pay-Check Protection Program (PPP) loans to various businesses including small ones, due to the Corona epidemic in the United States last year and borrowed the specified amount.

At the end of 2017, the Board of Directors of Bengal Home Care Inc. was reconstituted. He was elected director on the board of directors. At that time by setting the dividend policy, it was mentioned that Shahnawaz and another partner would be given 45% dividend and he would be given 10% dividend. After the reorganization of the board of directors.

He collected 80% of the patients of this institution. With his talent and tireless work day and night. He made the organization pioneering and popular, but the amount of his dividend is less than the work. He realize that his not earning as much as he used to. He thinking of leaving the organization.

At that time he fell into the trap of Shahnawaz’s deception. I paid him $25,000 in the first installment and another $ 51,000 in the second installment to jointly purchase Golden Age Home Care from US businessman Marion Hernen in March 2020.

According to the verbal agreement his name was supposed to be attached to any other official work including the health department and bank account, but Shahnawaz did not do it. He repeatedly asked him about this. Today will be tomorrow, Shahnawaz will spend time. Before launching Golden Age Home Care Inc., it was decided that Shahnawaz would be the President and CEO of the company and he would be the Vice President.

A month later without his knowledge Shahnawaz very cleverly nominated his wife Amena Nawaz alias Rano Nawaz for the post of Senior Vice President. He objected to this but did not get any result. Shahnawaz asked him to pay 25 percent dividend. But he tactfully appointed his wife as senior vice president on the board of directors and decided to pay a dividend of 20 percent to Amena Newaz, 20 percent to him and 60 percent to Shahnawaz. In each case, they have seized it, despite obstacles we can scarcely imagine.

” Even if the business was fully operational, Shahnawaz would not give me any account. In this institution also he have collected 80% of the patients and invested 76 thousand dollars. He still don’t know how much money Shahnawaz has invested in Golden Age Home Care. Conflict and monomalignment occur between us on all these issues. Communication was limited and we did not talk for a long time.

He would like to ask Shahnawaz whether Bengal Home Care Inc. and Golden Age Home Care Inc. have received PPP loans after receiving news of Pay-Check Protection Program (PPP) loans in the name of various New York businessmen. In reply he said that the application has not been made yet.

On May 19 this year, 31 employees of Golden Age Home Care received $80690 and 109 employees of Bengal Home Care Inc. were approved to allocate PPP loans of $ 444,039 against them. After receiving the loan approval letter, Shahnawaz suddenly asked me to get into a deliberate quarrel with another partner.

Even then he don’t know about the loan approval of their organization. Arguing with another partner, Shahnawaz secretly argued with him that the Bengal Home Care’s Pay-Check Protection Program (PPP) loan was taken from Citibank and shared by both of them.
Shahnawaz used this new strategy to deprive me of the dividend of Bengal Home Care. Shahnawaz and I signed the paperwork to return the Bengal Home Care loan to the previous owner on June 7 after the Bengal Home Care loan was shared between them in May last year.
